1. The rental equipment including all components shall remain the property of FANTASY Veranstaltungstechnik GmbH. The renter accepts the liability for the equipment from the time it leaves FANTASY's storage depot until its return thereto and bears full liability for any damage (damage to equipment caused by weather, third parties etc.). Stickers may be applied to tents only with the explicit permission of FANTASY Veranstaltungstechnik GmbH.

2. Equipment that is damaged or not returned to FANTASY Veranstaltungstechnik GmbH shall be invoiced to the renter at the price incurred for repurchasing or repairing it.

3. By signing the rental agreement (delivery note) the renter confirms that he has examined the equipment and found it to be in proper condition. Defects made known at a later time will not be recognized by FANTASY Veranstaltungstechnik GmbH. In the event that the renter fails to participate in inspecting the equipment on returning it to FANTASY, he shall be deemed to fully recognize the assessment thereof made by FANTASY Veranstaltungstechnik GmbH.

4. The party placing the order is liable for the order's correctness. In the event that the order is placed by, the ordered equipment used by and the invoice is addressed to various parties, the customer shall be deemed to be the party who placed by the order.

5. The minimum rental period is one day (24 hours). The explicit permission of FANTASY Veranstaltungstechnik GmbH shall be needed to shorten or extend the originally agreed rental period.

6. The renter shall not make any changes in the equipment. Any costs for restoring the equipment to its original condition shall be invoiced to the renter.

7. FANTASY Veranstaltungstechnik GmbH reserves the right to place advertising of a suitable size on the rental equipment. Logos and printing shall not be removed or obscured by the renter.

8. Any licenses or permits needed to operate or use the equipment as well as any type of performance permit shall be obtained by the renter at his own expense. FANTASY Veranstaltungstechnik GmbH accepts no liability for any damage or disturbance caused by the rented equipment.

9. The rental fee shall be paid on receipt of invoice for rentals inside Austria and shall be paid before commencement of the rental period for rentals outside Austria. Rental fees of less than € 364.- gross shall be paid immediately on conclusion of the rental period.

10. Orders placed verbally shall be confirmed in writing. If such confirmation is not revoked or altered within one week, the order shall be deemed binding. Cancellation of binding orders shall incur a cancellation fee as follows:

• 30 days before commencement of rental period, 10% of order
• 14 days before commencement of rental period, 25% of order
• 7 days before commencement of rental period, 50% of order
• 1 day before commencement of rental period, 100% of order

11. All prices are deemed exclusive of Value-Added Tax (MWSt.).

12. The parties agree that this legal relationship shall be governed exclusively by Austrian Law. Any disputes arising shall be subject to the jurisdiction of the appropriate court of law in Innsbruck.
